Terms & Conditions
Please do not think we are unfriendly, but we all need to know on what terms and conditions we process your booking. Please take a minute to read them before proceeding to the next stage
Use of the Booking Service and this site by you (the Customer) is subject to the following terms and conditions:
Booking Service (us) is the Bed & Breakfast Booking Service South Australia
Customer (you) means a person who books accommodation or tour through the Site.
Accommodation Property includes rooms in bed and breakfasts, cottages, guesthouses, apartments, hotels, motels or other accommodation.
Tour Service includes a business offering day tours, part day tours, muliti day tours, restaurant transfers, airport transfers, bus tours, rail tours but not regular public transport services
Site means this website, designed constructed and maintained by us, that offers the facility to book accommodation and tours to the public at large.
Accommodation Provider means the owner or authorised agent of the owner of an Accommodation Property who has agreed with us to list the Accommodation Property on the Site
Tour Operator means the owner or authorised agent of the owner of a Tour Service who has agreed with us to list the Tour Service on the Site
The Service acts as a booking agent for the Accommodation Provider or Tour Operator, making booking contracts between you and the Accommodation Provider or Tour Operator of the Accommodation Property or Tour Service that you have selected.
Bookings made through the Booking Service by the Customer are made on behalf of the Accommodation Provider or Tour Operator. The Customer agrees that the Accommodation Provider or Tour Operator has sole responsibility for delivery of the services being booked by the Customer and that the Booking Service is not liable for default by the Accommodation Provider or Tour Operator.
Payment for Bookings
The Customer agrees to pay to the Booking Service by debit to the Customer's credit card account the specified booking fee and the cost of the accommodation or tou. All fees are Tax inclusive where applicable. The Booking Service will issue the Customer with a valid confirmation in respect of each booking.
The Booking Service receives a payment from the Accommodation Provider or Tour Operator for providing this booking service.
The customer acknowledges that a third party (Card Authoriser) will process the credit card transactions required in respect of a booking. The Customer agrees that the Booking Service is not liable for default by the Card Authoriser.
The Booking Service reserves the right to refuse any booking and for an Accommodation Provider or Tour Operator to cancel any booking already made if the Accommodation Property or Tour Service becomes unavailable for reasons beyond the control of the Accommodation Provider or Tour Operator.
Individual Accommodation Providers or Tour Operators may apply their own Cancellation Policy and Cancellation penalties depend upon the policy of the Accommodation Provider or Tour Operator.
Where the Accommodation Provider or Tour Operator does not specify a Cancellation Policy then the following Cancellation Policy will apply.
Cancellations notified more than 28 days prior to the booking will incur a $50 (incl. GST) cancellation fee.
Cancellations notified 28 days or less and more than 14 days prior to the booking arrival date may receive a partial refund once a replacement booking of equal or greater value is secured.
Cancellation 14 days or less prior to the booking will forfeit all monies paid.
Any other changes to booking dates will incur a $50 amendment fee. No changes may be made less than 14 days prior to the booking arrival date.
A $50 administration fee applies to all booking cancellations and amendments.
You may be required to present photo ID on arrival at the Accommodation Provider or Tour Operator premises. A credit card pre-authorisation or cash deposit may be required to cover incidental charges.
No Smoking Policy
All Accommodation Properties and Tour Services are No Smoking indoors. If there is evidence of smoking indoors an additional $200 cleaning fee will be charged to the Customers credit card.
Disputes & Complaints
Information on the Booking Service website is based on details supplied by each Accommodation Provider or Tour Operator. Whilst the Booking Service endeavours to ensure all information presented is accurate, it makes no guarantee that the information is free from errors or faults, and accepts no liability for any errors or omissions as all information in relation to accommodation premises or tour is provided by the Accommodation Provider or Tour Operator.
The Booking Service makes no warranty or representation about the suitability of any product or service being advertised on this Site.
Any dispute between the Accommodation Provider or Tour Operator and you must be settled directly with the Accommodation Provider or Tour Operator, for whose actions the Booking Service can accept no responsibility.
Any complaints should be made in writing to the Booking Service for it to forward the complaint to the Accommodation Provider or Tour Operator, to enable the Accommodation Provider or Tour Operator the opportunity to remedy the complaint with you.
No responsibility will be accepted for complaints received more than 14 days after the event.
You must keep the Accommodation Property or Tour Service in good order and you will be liable to the Accommodation Provider or Tour Operator for any damages to the Accommodation Property or Tour Service.
The Booking Service, its agents and staff shall not be liable for any damages, injury, loss or delay howsoever caused whilst at the Accommodation Property or Tour Serviceor any related activity.
The Booking Service accepts no responsibility for any misrepresentation, unforeseen omissions or additional costs incurred in relation to information provided by the Accommodation Provider or Tour Operator.
The Booking Service is not responsible for the actions, defaults, or negligence of any Accommodation Provider or Tour Operator.
The liability of the Booking Service for loss or damage of luggage, compensation for distress, disappointment and loss of enjoyment is limited in total to the price of the accommodation or tour booked.
Third Party Commissions
The Booking Service does not pay commissions to Travel Agents using the Site. Travel Agents should contact the Booking Service to negotiate rates and commissions.
Personal Information & Privacy
The Booking Service needs to collect personal information about you to process your booking for accommodation. If the Booking Service cannot collect this information, it will be unable to make a booking in your name. The Booking Service respects your privacy and will only use or disclose your information in accordance with the Privacy Act 1988.
The Information provided will be used by the Bed & Breakfast Booking Service South Australia to process the booking in accordance with your instructions. The information will only be disclosed to the Accommodation Provider for the Accommodation Property that we book for you. The Bed & Breakfast Booking Service South Australia will not disclose the Information to any other person or organisation.
Due to a ruling by the Australian Taxation Office, the Goods and Services Tax (GST) is not applicable to all BnB's, cottages and guesthouses. Where applicable all rates include GST and your Booking Confirmation complies with the requirements as a Tax Invoice.
Laws of South Australia
This agreement is governed by the laws of South Australia (unless otherwise specified) and the parties agree to the appropriate jurisdiction for any legal proceedings arising out of this agreement.
The Booking Service reserves the right to change information published on its website at any time.
